Protecting women deprived of their liberty

CNDH issues Recommendation to the Governor of Zacatecas and the Attorney General of the state for violating the rights of a woman deprived of her liberty.

The National Human Rights Commission (CNDH) issued Recommendation 88/2020 to the Governor of the state of Zacatecas, Alejandro Tello Cristerna, and the Attorney General of that entity, Francisco José Murillo Ruiseco, for violating the human rights of a woman deprived of her liberty in the District Penitentiary Center of Calera de Víctor Rosales.

On February 13, 2020, several media outlets reported the case of a woman who was improperly interned for two months in said penitentiary center, where she was sexually assaulted on several occasions.

The State Human Rights Commission (CEDH) initiated an investigation and issued a Recommendation to the then Secretary of Public Security of that state; however, due to the seriousness of the facts, the CNDH took over the case, considering that this penitentiary facility does not meet the conditions to house a female population.

The CNDH determined that the victim should have been housed in the female penitentiary center of the entity and during its investigation it noticed that in the investigation file integrated by this case only an arrest warrant had been requested against the material author, without investigating other conducts or persons involved.

This National Organism also verified that this person was in a triple state of vulnerability, since in addition to being a woman and being deprived of her liberty in a penitentiary establishment for men, she was subjected to an environment of physical, psychological and sexual violence, and one of the authorities responsible for the facts was part of the custody corps who affected her integrity, thus violating her rights to personal and sexual integrity, to a life free of violence, to social reintegration and to access to the administration of justice.
