Cuauhtémoc City Hall of the CDMX fails to comply with a final award

The National Human Rights Commission (CNDH) issued Recommendation 71/2020 to the Head of the Cuauhtémoc Mayor’s Office of Mexico City, Néstor Núñez López, for the non-compliance with a final award issued by the Federal Court of Conciliation and Arbitration (TFCA).

The investigation carried out by this National Commission established violations of the human rights to legality, legal security, access to justice and reasonable time, to the detriment of a person who, on May 15, 2008, filed a labor lawsuit against the then Cuauhtémoc Delegation and demanded the reinstatement of his position, as well as the payment of various benefits for the unjustified dismissal to which he was subjected. 
The TFCA issued the corresponding award once the proceeding was exhausted.

In the award, the Mayor’s Office of Cuauhtémoc was ordered to reinstate the injured party in his position under the same terms and conditions that he had been performing, as well as to pay him various benefits and salary amounts, which did not occur in spite of the multiple injunctions issued by the Federal Conciliation and Arbitration Court.

Therefore, the victim requested the intervention of the CNDH, and a complaint file was created in which official letters were sent to the Cuauhtémoc Mayor’s Office so that it would take all internal steps to comply with the award. However, in spite of the 16 payment injunctions issued by the Second Chamber of the TFCA, the Cuauhtémoc City Hall did not comply with the award issued in favor of the victim.
