CNDH congratulates for the SCJN’s resolution to invalidate Tabasco’s “Garrote Law”.

The right to freedom of expression and social protest

The National Human Rights Commission (CNDH) welcomes the determination of the Supreme Court of Justice of the Nation (SCJN) to invalidate various articles of the Penal Code for the state of Tabasco, reformed and added by Decree 115, published on July 31, 2019, which established sanctions related to the exercise of the right to freedom of expression and social protest.

On the occasion of the reform to the Criminal Code of Tabasco, the NCHR found, after a thorough analysis of the reform proposals, that they could be contrary to several rights and freedoms of individuals, particularly those of legal security, freedom of expression, assembly and demonstration, for which reason an Action of Unconstitutionality was filed on August 30, 2019.
