Recommendation to the Government of SLP and the CEDH due to institutional and gender violence

The human rights of the victim have not been fully repaired by CEEAV-SLP

The CNDH received a complaint from the victim, in which she documented that despite being recognized as a victim of human rights violations, on the occasion of the issuance of recommendations by the ECHR and the National Commission, she has not received full reparation for her human rights, nor have she been granted the measures of help and immediate assistance by the State Executive Commission for Attention to Victims of San Luis Potosí (CEEAV-SLP); on the contrary, she considered that in retaliation for the legal actions taken to demand her rights, she has received discriminatory, negligent and inappropriate treatment by public servants of the State Commission.

The CNDH was able to prove that, over the course of six years, the victim has not received assistance measures, such as psychological care from ceeav-slp, and that the damage caused by the violation of his human rights remains unrepaired, a situation that has caused new effects on his health, such as alopecia and lack of control in his glucose levels. In addition, he has not been provided with medication, food and transportation expenses; nor was a specialized study carried out to collect the socio-economic characterization of the victim in order to make an adequate assessment of his or her specific conditions and needs since his or her entry into the State Registry of Victims.

TheNational Commission addressed six points of recommendation to the San Luis Potosi government and five more to the ECHR, among which it highlights that measures of help, assistance, and immediate attention to the victim be provided immediately; that collaboration be requested with the Executive Commission for Victim Assistance for the comprehensive reparation of the damage; that investigation procedures be initiated in the area of responsibilities to the public servants responsible; that a copy of the Recommendation be incorporated into their labor and personal files; and that the necessary administrative measures be adopted.
