NHRC directs recommendation to IMSS for medical malpractice at a hospital in Manzanillo, Colima

There was evidence of human rights violations to the detriment of a 3-month-old child.

The National Human Rights Commission (CNDH), addressed Recommendation 08/2021 to the Director General of the Mexican Social Security Institute (IMSS), Zoé Alejandro Robledo Aburto, for the inadequate care that six doctors of the General Zone Hospital N°10 (HGZ-10) in Manzanillo, Colima, provided to a 3-month-old minor, which resulted in his death. On May 8, 2019, the victim was admitted to Family Medicine Unit (UMF) 162, where a general practitioner attended him and gave him treatment for colic, but when the discomfort persisted, he was admitted again and another general practitioner diagnosed him with infectious otopharyngitis, acute bronchitis and, to rule out lower respiratory tract infection, provided the minor’s parents with a transfer letter to be urgently treated at HGZ-10.

According to the juridical logical analysis of the facts and evidence in the file, the CNDH had elements that allowed evidencing violations to the human rights to the protection of health, to life and to the best interest of the child. Therefore, this National Commission requested the General Director of the IMSS, together with the Executive Commission for Attention to Victims, to fully repair the damage to the victims and relatives of the minor, including a fair and sufficient compensation, in terms of the General Law of Victims; to register them in the National Registry of Victims, and to provide them with psychological and thanatological attention; to collaborate with the CNDH in the complaint filed before the Internal Control Organ of the IMSS against six doctors who attended the minor.
