NHRC directs a Recommendation to ISSSTE for medical negligence in a hospital in Aguascalientes that resulted in the death of a minor.

Violations of the rights to protection of health and life were evidenced.

The National Human Rights Commission (CNDH) addressed Recommendation 06/2021 to the General Director of the ISSSTE, Luis Antonio Ramírez Pineda, for the inadequate medical attention received by a child in the General Hospital of Aguascalientes, which resulted in his death, attributable to medical personnel assigned to that hospital.

This National Organism had elements that allowed evidencing violations to the human rights to the protection of health, to life, to the principle of the best interest of the child and to the access to health information to the detriment of the victim. The child, who was a carrier of dysmorphic syndrome, was admitted to the emergency department of that hospital with symptoms of vomiting and diarrhea, where the corresponding study protocols were initiated; however, he was diagnosed with intestinal occlusion, requiring urgent transfer to another hospital without success, which caused his health condition to deteriorate and subsequently he died.

The CNDH requested the General Director of the ISSSTE to coordinate with the Executive Commission for Attention to Victims to fully repair the damage to the minor’s relatives, including fair and sufficient compensation; to register them in the National Registry of Victims, to provide them with psychological and thanatological care, and to provide them with the medicines they require; collaborate in the complaint filed before the Internal Control Organ of the ISSSTE against the responsible authorities who provided medical care to the victim, as well as in relation to the inadequate integration of the clinical file.
