CNDH Addresses Recommendation to CFE for Injuries Caused to a Person

The lack of safety covers in subway installations of the CFE caused the victim to fall inside.

On February 2, 2018, the victim fell inside the electrical installations when he was walking on the south sidewalk of Emiliano Zapata Street, between San Marcos and Margil, in the Centro neighborhood of Mexico City, where an electrical equipment is located that lacked at that time of its covers, violating the victim’s right to integrity.

After its investigation, the National Human Rights Commission (CNDH) accredited that que CFE Distribución is the owner of the subway electrical line, which according to the opinion of an expert in electrical engineering assigned to the CNDH, does not comply with the specifications established in articles 923-19 and 923-20 of the Mexican Official Norm NOM-001-SEDE-2012, 42, as well as in number 4.1, clauses D and F, of the Construction Norm of Underground Systems of the de CFE, which causes the victim to fall into the interior of said installation.

Public servants assigned to CFE Distribución were aware of the dangers to which people were exposed due to the lack of safety equipment, since they recognize the recurrent theft of this type pf covers in their facilities, in addition to the fact that the subway line remained for at least three days without covers.

Despite this and the fact that an investigation file was opened before the Public Prosecutor’s Office, at the victim’s request to obtain reparation for the damages derived from the injuries he suffered, CFE Distribución tried to deny ownership of the subway electrical installations, with the intention of evading its obligation to compensate grievances.
