Unconstitutionality Actions

  • Detection and analysis of regulations.

    In the month of February 2021, the publication of 150 normative modifications issued by the legislative bodies of the federal entities and the Congress of the Union was detected.

    During February 2021, the Head of this Constitutional Body for the protection of human rights decided to exercise her power to promote unconstitutionality actions before the SCJN on seven occasions, for which 7 lawsuits were filed against various general norms that were detected in the newspapers and government gazettes of fourteen different federal entities. Said lawsuits were filed against the following legal ordinances:

    – Chiapas: 1 (Law of Law of the State of Chiapas) which gave rise to the action of unconstitutionality 33/2021.
    – Chihuahua: 2 (Revenue Law of the State of Chihuahua for the Fiscal Year 2021 and Administrative Code of the State of Chihuahua). The first one gave rise to the unconstitutionality action 35/2021 and the second one is pending to be filed.
    – State of Mexico: 1 (Law of the Autonomous University of the State of Mexico) which gave rise to the unconstitutionality action 36/2021.
    – Mexico City: 1 (Law for the Attention, Visibilization and Social Inclusion of Persons with Autism Spectrum Disorders of Mexico City) which gave rise to the unconstitutionality action 38/2021.
    – Zacatecas: 1 (Civil Service Law of the State of Zacatecas) which gave rise to the action of unconstitutionality 39/2021.
    – Nayarit: 1 (Archives Law of the State of Nayarit) which gave rise to the unconstitutionality action 41/2021.

    During February 2021, the Supreme Court resolved 8 unconstitutionality actions filed by the CNDH in previous years.
    Of the total number of unconstitutionality actions resolved in the month, 7 were suspended by the Supreme Court of Justice of the Nation since the challenged norms ceased their legal effects and in one it determined that it was procedural and founded.
