CNDH issues Recommendation to ISSSTE for inadequate medical care and obstetric violence in Querétaro hospital

Violations of the right to health protection and to a life free from obstetric violence.

On May 18, 2018, the victim who was also working at that hospital – went for medical care at 38 weeks of gestation and contractions, and was admitted to labor surveillance. Despite having a cesarean section scheduled, the gynecologist performed medical procedures to accelerate labor and gave her medication.

When she was admitted to the delivery room, the gynecologist tried to remove the baby with forceps without success, until he was assisted by another doctor. The newborn was treated in the Neonatal Intensive Care Unit (NICU) with a diagnosis of asphyxia; while the woman was readmitted to the operating room for obstetric hemorrhage, pathological delivery, uterine rupture and hypovolemic shock, and her uterus and an ovary were removed to save her life.

The analysis of the facts and evidence in the case file allowed this National Organism to prove violations of the right to access to health, to a life free of violence in its modality of obstetric violence, to personal integrity and to the best interests of the child. Therefore, it requested the Director General of the ISSSTE, together with the Executive Commission for Attention to Victims, to make full reparation for the damage caused to the victims and their relatives, including fair and sufficient compensation; to register them in the National Registry of Victims and to provide the woman with medical, psychological and/or psychiatric care; while the minor should be provided with neurological and rehabilitation care.
