CNDH issues Recommendation to the FGR for the torture of a person

The victim was detained by members of the then Federal Investigation Agency (Agencia Federal de Investigaciones, AFI).

This Autonomous Organism has repeatedly pointed out that the prosecution and punishment of crimes must always be carried out within the framework of the law and respect for human rights, and has emphasized the importance of ensuring that the unlawful conduct of public servants is also investigated and punished in order to avoid impunity.

According to the complaint filed before this National Commission, the victim stated that he was detained by several individuals in civilian clothes on December 8, 2005, at approximately 10:30 a.m., when he was driving on the Mexico-Cuernavaca federal highway. One of these individuals told him that he was an element of the then AFI and that he would perform a routine check; however, he was taken to Mexico City, where he was subjected to acts constituting torture with the purpose of incriminating himself as responsible for the commission of several kidnappings.

After the investigation, the CNDH determined that the intention of the elements of the then Federal Investigation Agency to keep the victim in custody on December 8 and 9, 2005, was to exercise acts of torture on him, since he was subjected to beatings, burns, nudity, sexual aggression and sexual aggression, sexual aggression, and a staging was carried out that was far from reality, in which he was injured, so that he would incriminate himself before the media, and once he was placed at the disposal of the ministerial authority, he continued to be physically assaulted because he did not want to sign his alleged statement; Likewise, it was concluded that the injuries that the victim presented were excessive and unnecessary for his detention and were also consistent with his manifestations.
