CNDH Addresses Recommendation to the SEMOVI for Not Complying with Rulings

Public servants incurred in responsibility in the performance of their duties.

This National Human Rights Commission (CNDH) found violations to the rights of legality, legal security and access to justice and reasonable time, attributable to public servants of the Secretariat of Mobility (SEMOVI), who did not reinstate the victim in the position of Administrative Services or in another status similar in salary and functions, with the character of base, under the same terms and conditions in which he had been working, in addition to the payment of wages accrued between 2013 and 2016, the recognition of the affected person’s labor seniority, from 2006 until his reinstatement, as well as the compensation for other legal benefits.

After its investigation, this National Autonomous Organism found that public servants from the SEMOVI incurred in responsibility in the performance of their duties by not complying with the obligation to abide the ruling, acting outside the guidelines that govern them.

Therefore, the CNDH recommended the head of SEMOVI to repair the damage to the victim, in the terms of the Victims Law for Mexico City, so that without further delay the award is complied with in all its points; to train the SEMOVI’s personnel of legal affairs and administration and finance areas on the rights to legality and legal certainty, access to justice and reasonable time.
