CNDH condemns aggressions against Óscar Kabata and famililia

Calls on SEDENA to comply with the debt owed to the victims and their families in compliance with Recommendation 38VG/2020.

The CNDH respectfully urges the Secretary of National Defense to fully assume compliance with Recommendation 38VG/2020, and the commitments made in successive meetings in which the CNDH has been present, so that the abuses, aggressions, provocations and acts of annoyance committed to the detriment of Oscar Kabata and his family, recognized in that recommendation, cease, since, in exercise of their right to freedom of expression, contemplated in Article 7 of the Constitution, they maintain a sit-in for several months outside the facilities of the Secretariat of National Defense, pending that authority’s compliance with the aforementioned Recommendation.

The facts that gave rise to the aforementioned recommendation concern the abuses that the Ministry of National Defense committed during the year 2009 in Ciudad Juárez, Chihuahua, where this National Commission was able to prove serious violations of human rights for the arbitrary detention, illegal detention, acts of torture and sexual violence, to the detriment of three people of whom one of them was deprived of his life. , when they were detained by public servants of the Ministry of National Defense; and twelve years after the commission of these acts, it is still not observed that SEDENA repairs the damage to the victims, so it is protesting outside the facilities of the Ministry of  National Defense.
